The question not asked: The challenge of pleiotropic genetic tests.Robert Samuel Wachbroit - 1998 - Kennedy Institute of Ethics Journal 8 (2):131-144.
: Nearly all of the literature on the ethical, legal, or social issues surrounding genetic tests has proceeded on the assumption that any particular test for a gene mutation yields information about only one disease condition. Even though the phenomenon of pleiotropy, where a single gene has multiple, apparently unrelated phenotypic effects, is widely recognized in genetics, it has not had much significance for genetic testing until recently. In this article, I examine a moral dilemma created by one sort of (...)

Becoming the Neighbor: Virtue Theory and the Problem of Neighbor Identity.Samuel K. Roberts - 2008 - Interpretation: A Journal of Bible and Theology 62 (2):146-155.
Ethical theories consistent with Christian moral sensibilities must assure each neighbor's dignity and recognize his or her unique needs. While utilitarian ethics and duty-based ethics may fail to some degree in these respects, virtue ethics offers perspectives that echo more faithfully the parable of the Good Samaritan.

[Book review] genetics and criminal behavior. [REVIEW]David Wasserman & Robert Samuel Wachbroit - 2002 - Ethics 113 (1):185-187.
In this 2001 volume a group of leading philosophers address some of the basic conceptual, methodological and ethical issues raised by genetic research into criminal behavior. The essays explore the complexities of tracing any genetic influence on criminal, violent or antisocial behavior; the varieties of interpretations to which evidence of such influences is subject; and the relevance of such influences to the moral and legal appraisal of criminal conduct. The distinctive features of this collection are: first, that it advances public (...)

    (1 other version)Withdrawal of Nonfutile Life Support After Attempted Suicide.Samuel M. Brown, C. Gregory Elliott & Robert Paine - 2013 - American Journal of Bioethics: 13 (3):3 - 12.
End-of-life decision making is fraught with ethical challenges. Withholding or withdrawing life support therapy is widely considered ethical in patients with high treatment burden, poor premorbid status, or significant projected disability even when such treatment is not ?futile.? Whether such withdrawal of therapy in the aftermath of attempted suicide is ethical is not well established in the literature. We provide a clinical vignette and propose criteria under which such withdrawal would be ethical. We suggest that it is appropriate to withdraw (...)

  14. Cooperation, Reciprocity and Punishment in Fifteen Small- scale Societies.Robert Boyd, Samuel Bowles & Herbert Gintis - unknown
Recent investigations have uncovered large, consistent deviations from the predictions of the textbook representation of Homo economicus (Roth et al, 1992, Fehr and Gächter, 2000, Camerer 2001). One problem appears to lie in economists’ canonical assumption that individuals are entirely self-interested: in addition to their own material payoffs, many experimental subjects appear to care about fairness and reciprocity, are willing to change the distribution of material outcomes at personal cost, and reward those who act in a cooperative manner while punishing (...)

Spheres of Morality: The Ethical Codes of the Medical Profession.Samuel Doernberg & Robert Truog - 2023 - American Journal of Bioethics 23 (12):8-22.
The medical profession contains five “spheres of morality”: clinical care, clinical research, scientific knowledge, population health, and the market. These distinct sets of normative commitments require physicians to act in different ways depending on the ends of the activity in question. For example, a physician-scientist emphasizes patients’ well-being in clinic, prioritizes the scientific method in lab, and seeks to maximize shareholder returns as a board member of a pharmaceutical firm. Physicians increasingly occupy multiple roles in healthcare and move between them (...)

    In Defense of Normothermic Regional Perfusion.Robert D. Truog & Samuel N. Doernberg - 2024 - Hastings Center Report 54 (4):24-31.
Normothermic regional perfusion (NRP) is a relatively new approach to procuring organs for transplantation. After circulatory death is declared, perfusion is restored to either the thoracoabdominal organs (in TA-NRP) or abdominal organs alone (in A-NRP) using extracorporeal membrane oxygenation. Simultaneously, surgeons clamp the cerebral arteries, causing a fatal brain injury. Critics claim that clamping the arteries is the proximate cause of death in violation of the dead donor rule and that the procedure is therefore unethical. We disagree. This account does (...)

Foundations of Human Sociality - Economic Experiments and Ethnographic: Evidence From Fifteen Small-Scale Societies.Joseph Henrich, Robert Boyd, Samuel Bowles, Colin Camerer, Ernst Fehr & Herbert Gintis (eds.) - 2004 - Oxford University Press UK.
What motives underlie the ways humans interact socially? Are these the same for all societies? Are these part of our nature, or influenced by our environments?Over the last decade, research in experimental economics has emphatically falsified the textbook representation of Homo economicus. Literally hundreds of experiments suggest that people care not only about their own material payoffs, but also about such things as fairness, equity and reciprocity. However, this research left fundamental questions unanswered: Are such social preferences stable components of (...)

The punishment that sustains cooperation is often coordinated and costly.Samuel Bowles, Robert Boyd, Sarah Mathew & Peter J. Richerson - 2012 - Behavioral and Brain Sciences 35 (1):20 - 21.
Experiments are not models of cooperation; instead, they demonstrate the presence of the ethical and other-regarding predispositions that often motivate cooperation and the punishment of free-riders. Experimental behavior predicts subjects' cooperation in the field. Ethnographic studies in small-scale societies without formal coercive institutions demonstrate that disciplining defectors is both essential to cooperation and often costly to the punisher.

    The Juristic Study of Law's Formal Character.Robert S. Summers - 1995 - Ratio Juris 8 (3):237-247.
.The author summarizes the essential elements of a general theory he is developing which he calls “The Formal Character of Law.” He explains that law's formal character is a potentially major branch of legal theory that is still relatively unexplored. In his view, it is possible to identify formal attributes in legal rules, other basic legal constructs such as interpretive method, the principles of stare decisis, legal reasons, and legislative and adjudicative processes, and a legal system viewed as a whole. An important part of our Theory of Mind—the ability to reason about other people's unobservable mental states—is the ability to attribute false beliefs to others. We investigated whether processing these false beliefs, as well as similar but nonmental representations, is reliant on language. Participants watched videos in which a protagonist hides a gift and either takes a photo of it or writes a text about its location before a second person inadvertently moves the present to a different location, thereby rendering (...)

  49. A Formal Theory of the Rule of Law.Robert S. Summers - 1993 - Ratio Juris 6 (2):127-142.
The author presents a relatively formal theory of the rule of law which includes three basic components: conceptual, institutional and axiological. He then emphasizes the differences between a formal and a substantive theory of the rule of law and highlights the advantages and limits of the former. Finally, the author indicates the importance of this type of theory, namely the values it implies such as predictability, justified reliance, autonomous choice, minimization of disputes and legitimacy.**.

  50. Formal legal truth and substantive truth in judicial fact-finding -- their justified divergence in some particular cases.Robert S. Summers - 1999 - Law and Philosophy 18 (5):497 - 511.
Truth is a fundamental objective of adjudicative processes; ideally, substantive as distinct from formal legal truth. But problems of evidence, for example, may frustrate finding of substantive truth; other values may lead to exclusions of probative evidence, e.g., for the sake of fairness. Jury nullification and jury equity. Limits of time, and definitiveness of decision, require allocation of burden of proof. Degree of truth-formality is variable within a system and across systems.
